Kansas Arts Commission Funding and Award Restrictions

1.

Organizations eligible for Commission funding must serve the citizens of Kansas as private, nonprofit, tax-exempt organizations or public, governmental entities. All applicant organizations must be in good standing with the Kansas Secretary of State's office at the time of appplication and be registered as Kansas domestic corporations. Nonprofit organizations must also have their federal tax-exempt status at time of application. Artists requesting support, or who apply to be listed on the Kansas Arts on Tour Roster, must reside in Kansas or their primary business address must be in Kansas.

The Kansas Arts Commission will not fund a project or a program that duplicates any other project or program funded by the Kansas Arts Commission, except through Operational Support.

An applicant may not apply for a portion or component of a project or program for which another applicant is also requesting support from the Commission. Support from the Commission for a collaborative or partnership project or program must be requested by only one organization.

4.

An applicant may apply for only one grant or award for the applicant's program or project.

5.

The contact person/project director listed on the grant application should be directly affiliated, either as an employee or ongoing volunteer, with the organization requesting funds. If that person is not an employee or ongoing volunteer with the organization, the applicant must include a letter from the authorizing official (see Definitions), specifying the relationship and that the organization authorizes the contact person/project director to direct the project or program.

If the applicant organization is part of a larger entity, the applicant organization must have a separate administrative and operational structure, board of directors or advisors, and budget.

7.

All official correspondence, such as contracts and grant payments, will be sent to the official address of the applicant. The applicant, not the Kansas Arts Commission, is responsible for ensuring that all correspondence is received and returned, when required, in a timely manner.

An applicant may not request an increase to the original grant request for any reason once the application has been officially submitted to the Commission.

9.

Support may be requested for performances or workshops by Kansas Arts on Tour roster artists only through the Kansas Arts on Tour Grant Program. If an applicant is requesting support to employ a Kansas Arts on Tour roster artist for a project or program not offered through the roster, or if the applicant and artist reside in the same county, the applicant may apply through different categories.

10.

Commission funds cannot be used for financing debts or for debt retirement.

11.

An applicant organization or agency may not request funds to compensate a member of its board of directors.

12.

An applicant may request support only for an arts project or program that occurs entirely during the state of Kansas Fiscal Year 2012 (July 1, 2011 -June 30, 2012) and in the state of Kansas, except for attendance at out-of-state arts and cultural professional development sessions such as conferences or meetings.

13.

A project or program for which Commission funding is requested must be open and accessible to the public. Funds granted by the Commission cannot be used for a project or program that occurs in a private dwelling place or other location perceived as not open to the public. Funds may not be used for scholarships, prizes, by-invitation-only fundraising events or conferences and meetings not open to the public. However, funds may be used to underwrite sliding-scale fees for classes or other paid, public events.

14.

No single individual can serve as a project director for more than four total grant applications submitted to the Kansas Arts Commission in a single fiscal year.

15.

Commission funding of up to $1,000 may be used for the purchase of nonstructural improvements to land and buildings, equipment, office furniture, fixtures and devices which have an expected service life of one year or longer. These are called capital expenses. These items may include electronic and computer equipment, musical instruments, prints, drawings, paintings, sculptures and building or facilities repair directly related to the arts project or program or to improve accessibility.

Commission funding may be used to purchase supplies and materials directly related to a project or program, but may not be used to purchase food, beverages or other hospitality items.

17.

A school, college or university may only apply for Commission funding to support a project or program that clearly serves the needs of the surrounding community or the state and is designed to involve a broad audience and/or participants. An activity that is credit-producing or oriented primarily to the institution’s student and academic community is not eligible except if the applicant is applying for funds through the Kansas Arts on Tour grant program. However, a project or program sponsored by an organization to assist a preschool, elementary or secondary school to accomplish required arts education standards may receive funding from the Commission.

18.

Universities or colleges and their endowments or foundations may not extract more than 25% of any grant from the Kansas Arts Commission for overhead or indirect costs or expenses.

19.

A public television or radio station may not apply to the Commission for funding to underwrite general operating budgets but may apply for support of arts programs that will be broadcast on that station.

20.

Commission funding cannot support religious services.

21.

Failure to submit final report forms from previous fiscal years will result in disqualification of current applications.

Civil and Human Rights

Signed Commission compliance statements and grant contracts indicate that the funded organization understands and is in compliance with the law.

Signature on the Compliance Statement also signifies that the applicant is in compliance with Title VI of the Civil Rights Act of 1964, Section 504 of the Rehabilitation Act of 1973, the Americans with Disabilities Act (ADA), and, where applicable, Title IX of the Education Amendments of 1972, the Age Discrimination Act of 1975, the Kansas Act Against Discrimination of 1991, the Drug-Free Workplace Act of 1988 and the Fair Labor Standards section of the Commission Regulations and Policies.
